Purpose: Investigate the allegations of a filed Application for Guardianship of a Person, of Person and Estate, or 1102 Court Initiated Guardianships

Court Investigator’s Report (CIR) – Texas Estates Code § 1054.153:

A Court Investigator Report is required in all applications for Permanent Guardianship, providing the Court with the findings and conclusions gathered during the investigation.

Newly Filed Guardianships

A Court Investigator will not be appointed to investigate a Permanent Application for Guardianship until all required documentation has been received (Ex: Certificate of Medical Examination, Background Reports, etc.). Upon appointment, a Court Investigator’ duties include the following:

  • Review the filed Application, Certificate of Medical Examination and all documentation submitted that is relevant to the case
  • Schedule an appointment with Proposed Guardian and the Alleged Incapacitated Person at the residence, and in some cases, speak with an individual who has notified the Court of opposition to the Guardianship or who are seeking to be appointed themselves.
  • File a Court Investigator’s Report with the Court and serve a copy to the Attorney(s) appointed on the case
  • Appear at Court hearing to testify, as needed

1102 Court Initiated Guardianship - Texas Estates Code § 1102.001:

An 1102 Court Initiated Guardianship is when an individual has concerns that a person lacks the capacity to make decisions for themselves regarding personal well-being, medical, and/or financial affairs makes a referral to the Court for Guardianship of that person. An 1102 Referral Form and/or a Certificate of Medical Examination (CME) is needed for consideration by the Court. Please see Probate Court Investigator's Office forms page. If the Court has probable cause to believe that a person is incapacitated, the Court shall appoint a Court Investigator or a Guardian ad Litem to investigate the information provided in the 1102 Referral Form and/or CME. If a Court Investigator is appointed, a Court Investigator’s Report will be filed in the case.

*Court Investigator Reports are not required for Temporary Guardianships.
