The Probate Court Investigators’ Office is responsible for investigating the necessity of a guardianship, and monitoring all guardianships that are created by the three Probate Courts for the lifetime of the guardianship. Every guardianship in Dallas County will have contact with this office and the Court to which it is assigned.  The centralized Probate Court Investigators’ Office works with all three Probate Courts. The primary goal of the Office is to ensure that all health and safety considerations of persons under guardianship are addressed appropriately, and that the guardians are acting in the best interests of the persons in alignment with their duties and responsibilities.

Pursuant to §1054.152 of the Texas Estates Code, the general duties of a court investigator include:

  • supervise a court visitor program established under Subchapter C
  • serve as chief court visitor
  • investigate a complaint received from any person about guardianship and report to the judge, if necessary; and
  • perform other duties as assigned by the judge or required by this title.

Pursuant to §1054.153 of the Texas Estates Code, a court investigator shall file with the court a report containing the court investigator findings and conclusions after conducting an investigation under Section 1054.151 or 1054.152.
