On October 21, 2023, Robert Charles Bailey was walking along the sidewalk next to Bishop Lynch High School around 1:55 am. The defendant was driving east on Ferguson Road in his Lexus sedan and as the road curved slightly north, he continued straight, off the road, up the curb, striking Mr. Bailey and sending him into the air and to his death. The defendant then crashed through a telephone pole, knocking out power to the area. The crash was captured on video from the Bishop Lynch Parking lot.
When police arrived, the defendant was sitting on the curb, a few feet away from Mr. Bailey’s dead body. When asked what happened, the defendant said he was drunk driving. The defendant was cooperative with the investigation, consented to giving a blood specimen and his Blood Alcohol Content was 0.116 about two hours after the crash.
The defendant had no criminal history and no bond violations. He pleaded guilty and true to the deadly weapon allegation. The jurors saw the crash video, some of the police bodycam videos, heard from several officers who investigated the case, and from three members of the Bailey family -- including his widow and mother of his 12-year-old son and 10-year-old daughter. The defense called a probation officer, pre-trial bond supervision, the defendant’s father, a close friend of the defendant, and the defendant also testified. We asked the jury to sentence him to at least 10 years in prison. The defense asked for probation. After deliberating for an hour and 20 minutes, the jury sentenced him to 10 years in prison.
GUILTY and sentenced to 10 years in prison + deadly weapon finding.
